JJ BILL OF RIGHTS – WE ALL DESERVE PROTECTION
BACKGROUND
- SB 823: Closes all youth prisons (DJJ) by 2023.
- Shifts responsibility for youth adjudicated of serious crimes from the state to the county.
- Under current law there is a Bill of Rights for youth at the state prisons but will not apply to youth in local lock up.
PROBLEM
The Current JJ Bill of Rights ONLY applies to state prisons meaning that any youth in a local lock up facility is not protected under the Bill of Rights!
SOLUTION
AB??: This new bill would re-enact and update the existing bill of rights so it applies to youth who are incarcerated locally.
WHAT WOULD THIS BILL DO FOR JJ YOUTH?
- PROTECTION: Implement a list of rights that would protect youth in local lock up facilities.
- ACCOUNTABILITY: Task the Juvenile Justice Ombudsperson with enforcement power to investigate complaints and report findings to the State.
- ACCESSIBILITY: Disseminate youth friendly content to notify youth of their rights and make sure they are posted in common living areas at ALL times.
